Obama to sign orders protecting gay, trans workers this coming Monday

AP is reporting that President Obama will sign two executive orders this coming Monday.

The first, protecting gay and transgender workers of federal contractors from discrimination; and the second, protecting trans federal workers from discrimination.

Interestingly, the executive order protecting gay and trans federal contracting employees will not include a newer, stricter religious exemption than already exists in previous executive orders covering other employees

enda-featuredAn increasingly number of vocal advocatees in the gay community have been demanding that the proposed religious exemption to ENDA (the Employment Non-Discrimination Act, legislation that would ban anti-gay and anti-trans job discrimination under federal law) either have a weaker religious exemption than previously proposed, or none at all.

It’s interesting, and brave, that the administraiton appears to be moving ahead without adding a stricture religious exemption. Gutsy even.

    If my religious beliefs tell me I shouldn’t hire LGBT people, it’s ok. If those same religious beliefs tell me that women don’t belong in the workplace or people of color should not mix with white people, the government says that’s discrimination and is illegal.

    So by his actions, Obama is essentially saying LGBT people are less than other minority groups.

    Also, tangential note: SyFy channel picked up a New Zealand show called “Almighty Johnsons”. The second episode I found a bleeped word rather unusual so I looked up the original NZ version. All it was, was the word “gay”. Not even “fag” or anything.
    Now, take that FX and Comedy Central say things like “shit” and … a few other terms that I’m forgetting but were odd hearing on basic cable, not even late at night. “Asshole” and “Shit” are okay for SyFy but not just “gay”? That feels a little weird to me.

    The religious exemption in the recent Senate bill, which the fundamentalist Christians wanted Obama to include in the executive order, and George W. Bush’s religious exemption are two completely different things. The religious exemption in the Senate bill allowed religiously affiliated employers to discriminate against gay people if they claimed that hiring gay people violated their religious beliefs—in short, an exemption for bigots. George W. Bush’s religious exemption only allows religiously affiliated employers to prioritize hiring members of their religion.

    George W. Bush’s exemption would give a Catholic hospital the option to prioritize hiring Catholics, but it would not give a Catholic hospital the right to refuse to hire gay people. If that Catholic hospital prioritized hiring Catholics, that would have to include gay Catholics as well as straight Catholics. The Senate bill, on the other hand, would give that same Catholic hospital the right to refuse to hire gay people if the hospital claimed that doing so violated their religious beliefs. Bill Perdue is playing dumb here and pretending that he doesn’t understand the content of George W. Bush’s exemption when, in fact, he understands it perfectly. I have a notion that Bill must have terrorized his parents when he was a child.

    The WH says that Bush’s bigoted exemption will remain. Outrage against bigots is never a waste of time for those who want to expand LGBT rights and protections.

    Monday is not all that far away. Perhaps we would be better off not wasting time on outrage over what might happen but isn’t supposed to according to John, and save it for when it actually happens.

    Bushes bigot enabling amendment to EO 11246 was retained and in the post Hobby Lobby legal world can and will be used to try to expand discrimination in hiring and on the job harassment.

    Firing will likely be continued excused with lies about job performance or other question instead of open bigotry but this EO and the Hobby Lobby decision will only embolden the bigots.

    This amounts to taking one step forward and one step backward.

    On July 8, National Gay and Lesbian Task Force (among others) withdrew their support from the Senate ENDA bill (the one with the religious exemption), and I don’t blame them. This EO doesn’t have the religious exemption, so I’m not surprised that NGLTF supports it.

    I’d be happier if he were to go on national television and throw the gauntlet down. Someone on the national stage needs to call Republicans out and ask them why they think it’s acceptable to deprive someone of their livelihood or home based on perceived sexuality.
